Regina police officer charged with assault says he felt threatened

A 17-year veteran of the Regina Police Service was in court Wednesday facing a charge of assault.

47 -year-old Colin Magee was charged after an incident in September of 2018 where he assaulted 42-year-old Lucien Gaudette in the cells area of the police station.

Video played for court Wednesday show the two men standing opposite one another with Magee explaining to Gaudette about forms that need to be filled out.

At one point during the release process, Magee testified he felt threatened because Gaudette refused to drop a pen that Gaudette was holding. When Gaudette, who was in jail after allegedly assaulting his ex-wife, did not do so,  he was tripped and pushed to the ground by Magee who claimed to be protecting himself

Magee said he had been attacked before by someone with a pen while processing them and that the refusal to drop the pen was seen as a threat to him.

Magee filed an incident report several days after the incident saying Gaudette had raised the pen to shoulder height, but the video shows that did not happen.

The judge in the case reserved decision until January 16.
